It is only illegal if you get caught...
"The Department of Justice launched an investigation into the 'No Poaching' agreement between Apple and Google in 2010, but details of the case were only made public for the first time yesterday. TechCrunch was the first to sift through the documents, and has uncovered some ostensibly incriminating evidence against not only Google and Apple, but Pixar, Lucasfilm, Adobe, Intel, and Intuit, as well. According to the filings from the U.S. District Court for the Northern District of California in San Jose, these companies did indeed enter 'no poach' agreements with each other, and agreed to refrain from soliciting employees. The documents also indicate they collectively sought to limit their employees' power to negotiate for higher salaries."

people used to complain about no poaching agreements, but its that kind of agreements and stuf in that style that avoid fucking Microsoft from monopolizing a lot of stuff.

thats not the part i was defending atlas. i was defending the part where youre not allowed to overcome and overpower another smaller company by taking away its resources.

they made that agreement to keep their employees locked into their jobs. that is colluding to basically hold those employees down and keep them in the same job or with the same company.

It's a double edged sword, it has a good and bad point. On the one hand it keeps companies from buying out all the new found talent and monopolizing the industry. On the other it means they can't get job offers until they quit and their talents may be undervalued as a result. However it's fairly easily overcome, poaching involves the company engaging the employee to offer services, but if an employee wants to ask around to see if anyone has a better offer that's fine.

plus the poaching is just between two companies. the employee is free to pursue jobs in other places wihtout poaching agreement.

yes thats 6 major companies, who offer salaries WAYYY above the average to their employees, amongst the hundreds of thousands of other companies in USA alone.
